Parties and payments
Before negotiations, it is useful to separate the parties’ responsibilities, determine the payment method and establish the full cost structure rather than focus only on the listing price.
Defines the property’s intended use and budget, prepares identification documents and documents confirming the source of funds, selects an independent escribano and agrees the scope of checks before transferring money.
Confirms authority and title to the property, collects property documents, discloses material ownership terms and prepares a clear procedure for vacating and handing over the property.
Buying property and obtaining immigration status are separate processes: the property itself does not replace the residence or citizenship procedure. Before choosing a payment method, check the requirements of the bank, escribano and other transaction participants for identification, documents, transfer of funds and proof of their origin.
Checks before making commitments
A listing and viewing help you choose a property, but the decision to proceed must be based on documents, the parties’ authority and the property’s actual condition.
The escribano verifies the parties’ identities, the basis for representation and the documents establishing the seller’s authority to dispose of the property.
Property documents, registered restrictions, obligations and information that may affect transfer of title are reviewed.
The address, area, cadastral information, layout, permits and actual use must be consistent with one another.
The document should clearly state the amount and payment procedure, time limits, property being transferred, inspection terms, responsibilities and the time of handover.
Do not transfer money solely on the basis of a listing, correspondence or a verbal agreement.
Check for debts on the property, building, utilities and other liabilities related to the property.
For an apartment, review the building rules, meeting minutes, gastos comunes and plans for major works.
For a house or plot, compare boundaries, access, buildings, utilities and permitted use.
For a new development, separately check the land, permits, developer, project stage and contractual scheme.
Record the condition, included equipment, meter readings, keys and actual handover date.

Frequently asked questions
Property search and the migration procedure are separate processes. Before the transaction, check with the chosen escribano which buyer documents, payment arrangements and title-registration requirements apply to your situation.
There is no automatic transition from property ownership to migration status. Residence and citizenship are issued according to their own rules and are not replaced by a purchase agreement.
The escribano checks the legal aspects of the transaction, documents and authority; prepares or reviews contract documents; and oversees title registration. The scope of work and responsibility should be agreed before reservation.
Individual actions can be taken under properly executed powers of attorney, but the acceptability and wording of the power of attorney must be agreed in advance with the escribano, bank and other participants in the specific transaction.
Costs may include professional services, taxes and registration formalities, commission, certificates, translations, bank costs, debts or settlements relating to the property, insurance and preparation for ownership. The exact breakdown depends on the specific transaction.
