Citizenship of Uruguay (ciudadanía legal)

Carta de Ciudadanía confirms legal citizenship status in Uruguay. The application is handled by Corte Electoral, not immigration. Before applying, the period of habitual residence, travel abroad, income, family circumstances, witness requirements, and knowledge of Spanish are taken into account.

Carta de Ciudadanía
A Corte Electoral document confirming legal citizenship status in Uruguay.
Nationality
A separate legal concept that does not coincide with ciudadanía legal.
Passport
It is obtained through a separate procedure and is not issued automatically with Carta.
Credencial cívica
Electoral document; after receiving Carta, a separate procedure applies.

Constitutional criteria

Three years with a family or five years without it: what conditions Corte takes into account

Article 75 of the Constitution provides for different periods of habitual residence, but the duration of residence is only one of the conditions.

Three-year scenario

Three years of habitual residence are provided for a foreigner of good character who has a family established in Uruguay and a confirmed occupation, income, or other stable connection with the country. Marriage or the birth of a child does not cancel the other conditions.

Five-year scenario

In the absence of such a family, the Constitution provides for five years of habitual residence, together with other criteria. Corte assesses the actual habitual residence, not just the date of issue of the permanent residencia, and requests DNM information.

Chronology of residence

Departures, livelihoods and establishment

  • Income and occupation are documented for the required three or five years.

  • Employment, self-employment, company, pension and other sources of income are confirmed by various documents.

  • Owning an apartment does not give the right to ciudadanía legal. Real estate can demonstrate means of subsistence if it generates documented rental income.

  • Discrepancies in dates, addresses, names, and immigration movements should be identified before filing.

Personal filing

Witnesses, Spanish and documents

Filing is free and takes place in person. Corte Electoral decides whether the submitted documents are sufficient.

  1. Civil-status records and certificates

    Collect civil status documents, identity documents and DNM certificates in accordance with Corte Electoral requirements.

  2. Evidence of the period

    Prepare proof of habitual residence and livelihood for all three or five years required.

  3. Witnesses

    Choose witnesses over the age of 25 who have known you for the required period. Close relatives, employers, employees, and some officials cannot be witnesses.

  4. Spanish

    The applicant must understand the questions and be able to communicate in Spanish.

  5. Personal filing

    Schedule an appointment and submit documents in person to the relevant Corte Electoral division.

What Happens After Getting Carta

Credencial and passport

There is a separate three-year period for credencial cívica and the exercise of electoral rights. After Carta, you can apply for a passport, but it is issued separately according to its own requirements and terms.

Original nationality

Obtaining ciudadanía legal does not automatically mean renouncing the original nationality under Uruguayan law. The consequences for the original nationality depend on the legislation of the country of origin.

Frequently asked questions about ciudadanía legal

Do I need a permanent residency first?

Corte evaluates habitual residence and requests DNM certificates on residencia and travel. The date of issue of permanent status does not in itself determine the beginning of the period.

Is it enough to live exactly three or five years?

No. The period of residence is only part of the criteria. Corte also assesses good character, the family basis for the three-year scenario, means of subsistence, establishment, travel abroad, witnesses, documents, and the ability to communicate in Spanish.

Can I obtain ciudadanía legal by buying a home?

There is no automatic citizenship through investment in real estate. Ownership of property can be considered a means of subsistence only with documented rental income and does not negate the other criteria.

Does Carta immediately give you a passport?

No. After Carta, the passport is issued separately according to current requirements. Processing times and visa-free destinations must be checked at the time of application.

A three- or five-year residence period is the starting point, not the only condition for obtaining Carta.

Compare the dates of stay and travel with the DNM certificates, prepare proof of income for the entire period and select suitable witnesses in advance.
