A foreigner can consider buying property in Uruguay without waiting for citizenship. But the right to buy a property does not mean that every transaction is straightforward or that real estate automatically grants residency or high returns. A title check, the involvement of an escribano, tax calculations, and a property valuation are necessary.

Buying makes more sense than renting when you know the neighborhood, plan to stay for a long time, and retain a reserve after the transaction. In the first months after moving, renting is often safer: it lets you get to know the city without tying up capital in an unfamiliar market.

When buying makes sense

Compare not monthly rent with the price of a property, but the cost of ownership over the anticipated period. The buyer pays for the transaction, taxes, maintenance, repairs, and the eventual sale. The tenant retains flexibility.

Buying makes sense if the time horizon is long, income is stable, the area has been checked, and the property does not absorb the entire reserve. It is risky if the decision is driven by fear of rising prices or the promise of quick residency.

Develop sale scenarios for three, five, and ten years from now. Factor in the time needed to find a buyer and currency risk.

Foreign Buyers’ Rights

In practice, foreigners buy real estate using a passport or a local ID card. However, the bank, the escribano, and the seller verify identity, marital status, and the source of funds.

Before paying a deposit, clarify which document will be used, whether a local tax ID is required, and which foreign documents must be provided. If the buyer is married, the marital property regime affects the required signatures.

Buying property alone does not replace the immigration process. Residency must be obtained on its own legal grounds.

The Role of an Escribano

An escribano checks the title, restrictions, debts, and the parties’ documents; prepares the transaction and handles registration procedures. Choose an independent professional rather than relying solely on the developer’s or seller’s representative.

Before paying any money, ask for a written opinion on ownership, encumbrances, taxes, plans, and the building’s compliance. A verbal “everything is clear” is not enough.

Agree on fees, taxes and expenses in advance. Get the full presupuesto.

Deposit and preliminary agreement

A reservation fixes the price and deadline but creates obligations. The document should describe the property, the parties, the amount, refund conditions, and the due-diligence findings that allow the buyer to withdraw.

Do not transfer the deposit before verifying the recipient and reviewing the text. A clause requiring forfeiture of the entire amount for any withdrawal is too risky if the legal review is still incomplete.

Include financing and the sale of other property as conditions if the transaction depends on them.

Currency and origin of funds

Properties are often advertised in dollars, but payments and taxes may be subject to their own rules. Specify the currency, exchange rate, and bank transfer route. Do not carry a large sum of cash.

Prepare statements, sale contracts, tax documents, and other evidence of the source of funds. The bank and the professional are required to carry out checks.

International transfer fees and conversion costs are part of the transaction cost. Make a test payment in advance.

Total Cost

In addition to the price, you must pay escribano fees, taxes, registration fees, an agent’s commission, and for a technical inspection. After purchase, there are annual charges, gastos comunes, insurance, and repairs.

Request an estimate before making an offer. Separate the buyer’s and seller’s expenses. Do not use a percentage from an old video as a universal formula.

Keep a reserve for at least the first year and unexpected repairs. Buying without liquid funds after receiving the keys increases risk.

New construction

For an off-plan development, check the land, permits, developer, schedule, specifications, and the payment-holding mechanism. A beautiful rendering does not confirm authorization to build or quality.

The contract should describe the area, finish, parking, completion date, permitted delay, and refund terms. Clarify whether the project can be changed and how the property is accepted.

An installment plan from a developer is not the same as a bank loan. Review the interest, indexation, penalties, and consequences of construction delays.

Existing Apartment

In addition to the title, check the building’s condition, minutes of general meetings, debts, gastos comunes, and future repairs. A cheap apartment may require a large contribution toward the façade or elevator.

Order a technical inspection: moisture, electrical wiring, plumbing, windows, and structure. Do not limit the inspection to cosmetic issues.

Check whether the layout complies with the registered documents. An unauthorized addition creates a problem when selling.

House and plot

For a house, examine the boundaries, road access, water, septic tank, roof, and land-use designation. Rural land has additional restrictions on use and subdivision.

Do not assume that any large plot of land can be subdivided and resold. The minimum size, category, and local plans determine whether division is possible.

Check easements, flooding and actual fencing. The map and the fence may not match.

Historic house

An older property may be architecturally attractive, but it may have heritage status, renovation restrictions, and high maintenance costs. Check which changes are permitted and whether approvals are required.

An engineer assesses the structure, roof, moisture, and utilities. The cost of restoration must be factored into the price before purchase.

A historical legend does not enhance legal value without documents or eliminate technical risk.

Investment returns

The promised ROI is not a guarantee. Calculate net income after vacancy, commissions, taxes, repairs, furniture, and management. For a seasonal property, use actual rental months rather than the peak January rate for the whole year.

Check the demand for long-term and short-term rentals, building rules and possible restrictions. Income in dollars and expenses in pesos create a currency effect.

Run a stress scenario with several months of vacancy and major repairs. If the project is no longer viable, the risk is too high.

Liquidity

Real estate cannot be sold instantly at the appraised price. Selling time depends on the area, condition, price, and market. A large, unique house may take longer to sell than a standard apartment.

Before buying, look not only at listings but also at their listing history. Ask who the typical future buyer would be.

Do not use money that may be urgently needed for relocation, medical care, or business.

Final Steps

First, live in the chosen area. Then set a budget with a reserve, choose an independent escribano and a technical specialist. Inspect the property before making an unconditional deposit.

Obtain a complete estimate of transaction and annual expenses; review the contract, source of funds, and registration process. After the purchase, keep title documents, receipts, and the technical report.

Buying property in Uruguay can be a sustainable solution for living and investment if it is based on due diligence and a long-term horizon. It becomes dangerous when market research is replaced by belief in automatic returns or an immigration privilege.
